To hold by the courtesey of iglōde is ther where a man taketh a wyfe iheryte / & they haue issue a some or a doghter & the wyfe dyeth whether the issue be ded or a lyue / the husband shall hold this land for terme of his lyft by the cortesye of englond / and by the law / for in this case the fee and the ryght remaynyth in the person of hym of whom he holdyth / And for that this tenant may not aleyn in fee nor for terme of a nother lyfe / and yf he do it is well lawfull to hym in the reuercyon to enter .

¶ To hold in fee symple is to hold to any man or woman to hym and to his heyrys and to his assyners for euermore .

¶ To hold in fre hold is to hold for terme of his own lyfe or for terme of anothermannys lyfe and in this case the fee and the ryght remayneth in the person of hym of whome he holdith / and for that this tenant may not aleyn in fee nor for terme of lyfe / And if he do it is well lawfull to hym i whome the fee & the ryght abydyth to enter .

¶ To hold in dower / is where a man in he ryte takyth a wyfe and dyeth / the heyre shall enter & indowe the wyfe of the thryd parte of all that that was to her husband in his lyfe in fee symple or fee tayle / and she shall hold these landis for terme of her lyfe as her free hold .

¶ To hold for terme of yeres is not but chatell in effect / for no accion is maytenable agayns the termour as to the recoueryng of the free hold / for no fre hold is in hym / a lesse for terme of yeres is chatell reall / and other chatell is all good is which is moueable .

¶ To hold i morgage is to hold to certeyn terme vppon condicion that yf the lessour pay somuch money at such a day that he may enter / & yf not that the other shal haue a fee symple or fee tayl or fre hold / & i euery case wher landis or tenementis be gyffyn to a man to a certayne terme vppon condycyon of that part of the lessour for to make the lesse to haue more long tyme or terme yf the other do not as the condicion ys / the londys & tenntꝭ vntyll the day that ye condicion shuld be done / be holdyn in morgage / as in a dede gage .

¶ And note well that yf land be let to a man in morgage i fee symple or i fee tayle vppon condycion that yf the furst lessour as is before seyd pay so much money at sych a day that he may enter / and yf not that the lesse haue the same estate in the landys that the lessour dyd hym graunt at the begynnyng . and yf before the day assyned the lesse be dissesyd he shal haue assise of nouell disseysyd . & i case that yf the lesse take a wyfe & dye seysed before the day assyned the woman shal be endowed .

¶ And note well that yf the lessour after the deth of the lessee pay not the money at the day assygned then the woman shall hold her dower and the issue his herytage .

And in case that the lessour at the day assyned pay the money to the heyre of the lessee than he may put out the woman & the heyre also / of all the land furst let / And yf a man gyft landys to another in the tayle yeldyng to hym a certayn rent by the yere / & an entre for defaut of payment / the donee takyth a wyfe & dyeth seisyd / the woman shal be indowyd / An in case the after the rent be behynd the donour may enter & put out the woman & the heyr also .

¶ And note well that yf landys be lett to a māin morgage in fe vppon condicyon / the lessee doth aleyn / the lessour shal be chargid to pay the money to the alyene & not to the feffee as it is sayd :

¶ To hold in burgage is to hold as yf the bnrgeys hold of the kyng or of another lorde landys or tenementys yeldynge to hym a certayne rent by the yere / or ellys there where an other man than burgeys holdith of any lord landꝭ or tenementis i but gage yeldynge to hi a certayne rent by yere

¶ To hold in socage is to hold of any lord landis ortenemētꝭ yeldynge to hym a certeyn rent for all maner seruyce .

¶ And note well that to hold by socage is not to hold by knyghtys seruyce / nor there longyth not ward mariage nor relyef / But they shall double onis theyr rent after the deth of theyr auncetours acordynge to that that they be wont to paye to theyr lorde / And they shall not be ouer mesure greuyd as it apperyth in the treatyse of wardis & reliefys .

Socage in auncyent tenure / ond Socage in basse tenure / Socage in free tenure is to hold frely by certayne rent for all maner of seruyce as is before seyd / and of that the next kinꝭ body shall haue the ward to whome the herytage may not destend / till the age of . xiiii . yeres that is to sey / yf the heritage come by the part of the fadyr / they of the part of the modyr shall haue the ward and contrary wyse .

¶ And note well that yf the gardeyn in socage do wast he shall not be pechid of wast but he shall yelde accompt to the heyre whan he shall come to his full age of . xxi . yeres / and loke the statute of marlebryge . capitilo . xv . for this matter / Socage in auncyent tenure is that where that people in auncyon demesne hold which vse no nother wryt to haue than the mōstrauer for to discharge them when yeyr lord distrayneth them for to do other seruyce that they ought not to do / & this wryt ought to be brought agayns the lord / and those tenentys hold all be on certayne seruyce / & they be free tenantis of auncion demesne / Socage in basse tenur is wher a man holdith in auncion demesne that may not haue the mōsttaruerunt / and for that it is callyd the basse tenure .

¶ To hold in fee ferme is to hold in fee symple yeldyng to the lord the valwe or at the / lest the forth part by yere / and he ought to do no nother thyng but as it is conteynyd in the feffement / and he that holdyth in fee ferme owght to do fealte & not relyef .

¶ To hold in frank fee is to hold in fee symple landis pledable at the commyn law .

¶ To hold in fee basse is to hold at the wyll of the lord .

¶ To hold in pure villennage is to do all that the lord wyll hym commaunde / The difinicion of villenage is villeyn of blod & of tenure / and it is he of whom the lord takyth redempcion to marye his doughter / or to make hym free / and it is he whom the lord may put out of his landys and tenementys at his will / and also of all his goodys and catell .

¶ And note well that a sokman is no pure villeyn nor a villeyn owyth not ward mariage nor relief nor to do no nother seruyce reall .

¶ And note well that the tenure in villenage shal make no fre man villeyn if it be not contynued syth tyme out of mynd nor villeyn land shall make no fre man villeyn / nor fre land shal make no villeyn fre but yf that the tenaunt haue contynuyd fre sith the tyme of no mynd / But a villeyn shall make free land villeyn by seysyn or claym of the lord

¶ And note wel that yf a villeyn purchase certayn land & take a wyfe and aleyu and dyeth before the claym or seisyn of the lord the wyfe shall be indowed .

¶ And note well that in case that the lord bryng a precipe quam reddat agayns the aliene the which vonchith to warrant the issue or of the villeyn which is villeyn to the lord / he shall haue the voncher / and by protestasyon the lord may saue that notwithstondyng that he plede with his villeyn / yet his villeyn shall not be in fraunchisid .

¶ And note well that a bastard shall neuer be iugyd villain / but by knolege in cowert of record .

¶ And note well that yf det be dew by a lord to a freman and he makyth .ii. men his executours the which be villeyns to the seyd lord & dyeth the villeynys shall haue an accion of det agayns theyr lord . And not withstondyng that he plede with them / and if he make protestacion they shal not be for so mych infraūchesid / for that that they be to recouer the det before sayd to the vse of another parson / that is to say to the vse of theyr testatour and not to theyr own vse / And if the tenant in dower haue a villeyn which purchesith certayn lond in fee and after the tenent in dower enteryth she shall haue the land to her & to her heyris for euer more & the same law is of tenent for terme of yerys of a villeyn .

¶ And note well that the lord may rob his villayn bete & chastyce at his will / saue only that he may not mayne hym / for than he shal haue appell of mayne agayns hym .

¶ And note well that a villeyn may haue .iii. accions agayns his lord that is to sey appell of deth of his auncester appell of rape don to his wyfe and appell of mayme

¶ And note well yf .ii. parceuers bryng a wryt of neofe and one of them be nonsute / the nonsute of hym shal be tuggid nonsute of them both so that if the nonsute be after apparance they shal be put out from that accion foreuer / for the law is such in fauour of liberte .

¶ And note well if .ii. haue a villeyn in comyn and one of them make to hym a manumission he shall not be made fre agayns both .

¶ And note well that in a wryt de natiuo habendo it behouyth that the lord shew how he comyth preucy of the blod of that villeyn of whom he is lord &c. & yf he nor none of his auncestours were not seysid of none of his blod / he shall not wyn by his accion / yf the villeyn haue not knolegyd in court of record hymselfe to be his villeyn .

¶ And note well that in a wryt of nyefe may not be put moo nyefys than twayn / but i a writ de libertate ꝓbanda may be put as maney nyefys as the pleintyf wyll .

¶ And note well that yf the villeyn of a lord be in auncion demesne of the kyng or other town pryuylegyd / within a yere and a day the lord may seyse hym / & if he dwell in the same town or other lace fraunchesid by a yere and a day without seysyn of the lord he hath no power to seyse hym after / yf he go not in estray owt of the forsayd fraunchese .

¶ To hold in the tayle is where a man holdyth certayne landys or tenementys to hym and to his heyrys of his body begoten .

¶ And note well that if the lond be gyffyn to a man & to his heyres malis and he hath issu male / he hath fee symple . & that was adiuggid in the parleament of our lord the kyng . But where landys or tenementis be gyffyn to a man & to his heyris malys of his body begoten than he hath fee tayle & the issue femall shal not be īherytable / as it appethry the .xiiii. yere of edward the .iii. in assise .

¶ To hold in the tayle after possibilite of issue extent is where landys is gyffyn to a man & to his wyfe and to the heyris of theyr .ii. bodyes ingendred and one of theym ouerlyffyth the other without issue betwen than goyng owt / he shall hold the land for t̄me of his own lyfe as tenent in the tayle after possibilite of issue extynct . And not withstondyng that he do wast he shall neuer be impeched of that wast .

¶ And note well yf he aleyne / he in the rexcion shal not haue a wryt of entre in cōsīli casu . But he may enter & his enter is lawfull ꝑ Robertum Thorp chefe Justic̄ .

¶ To hold in frank mariage is to hold in the second tayle lymyt in the statute of westm seconde . Capitilo primo . And the feffour shall acquyt the feffe of all maner of seruyce vnto the fyfte degre be past . & the feffour shall do all the seruyce & suytes duryng the sayd terme / & aft that heyris of the feffe shal do it / for that that the p̄uite of blod is past & yf he be dystreynyd for seruyce he shall haue a wryt of mesne agaynꝭ hym supposyng that he hyld the landis of hym / but he shall not haue the foriugment yf it be not in auauntage of his issues And note well that after the .iiii. degre be past he shal be atendant of as mych seruyce to the donour as the donour is attendaunt to the lord peramount & if he do selony for which he is attayn / the kyng shall haue his landꝭ for terme of his lyfe naturall / & after his deth his issue shal inherytcas by force of that tayll & i vis case none shal haue his landis by way of escheyte no more than in any other tayll / And in case that the tenaunt dye without heyre of his body begotton the land shall reuerte to the donour as it shuld in the commyn tayle / And if a man lett his land to another in frank mariage yeldinge to hym a certeyn rent by yere he shall hold this land in the tomyn tayle and not in frank mariage for by the rent reseruyd these wordys in liberum maritagium be all vtterly voyd so that the tenoure shal be intendyd after the tenuer in the commyn tayle .

¶ And note well that a man shall not gyft londys nor tenementys in frank mariage but where the woman is preuey of blod to the donour / for ellys the man nor the woman shall haue no nother estate by the feffement but forterme of lyfe

¶ To hold in franke almoyne is to hold landis or tenementis for to serue god & holy chirch to indow without doyng any other maner of seruyce / And note well that in this case le donour ys measne & ought to acquyte hym frely agayns the chefe lord / & also they that hold i frank almoyn shal do no fealte / but they that hold i frank mariage shall do fealte .

¶ Ther be thre maner of rentys that is to sey rent seruyce rent charge and rent sek rent seruyce is where a man holdyth of a nother by fealte and for to do suyt to his court and yeldynge to hym a certayn rent by the yere for all maner of seruyces .

¶ And note well that yf the lord be seysed of the seruyce & rent beforesayd and they be behynd and he dystrayne and the tenant rescow the distresse he may haue assise or a wryt of rescous / but it is more necessary for hym to haue assise than a wryt of rescouse / for so much that by assise he shall recouer his rent and his damagis / but by a wryt of rescous he shall not recouer but the thyng and the damagis .

And yf the tenant dye the same tyme and his issue enter / the lord shall haue agayns the issue a wryt sur cessaunt / or yf the tenant alayn / the lord shal haue agayns the alieue the foresayd wryt But yf the lord haue issue and dye and the tenant be in arerage of the sayd rent and seruyce in the tyme of the fadyr of the issue and not in that tyme of the issue / he may not distrayne for the areragis in the tyme of his fader / & he shal haue no nother recouere agayns the tenant or any other for that that sych aduauntage is gyffyn by the law to the tenant .

¶ And note well that rent seruyce is / to the which belongith fealte / but to rent charge and rent sek longyth not fealte but yt belongyth to rent seruyce of comyn ryght .

¶ Rent charge is where a man grauntyth certayne rent goyng owt of his landys or tenementys to a nother in fee simple or in fee tayle or for terme of lyfe by dede vppon condycionn that at what day that the rent be behynd it shal be well lawfull to the graunte or his heyres or assynys to distreyn in the same landys or tenementys .

¶ And note well that yf the rent be behynd it is well lawful to the graunte by eleccyon to haue a wryt of annuite / or ellys he may distreyn / & yf the dystresse be takyn agayns his will fro hym & he was neuer seysyd before he hath no recouere but by writ of rescous / for the distresse furst takyn gyffyth not to hym seisi but yf he hap the rent before for yf he were seisyd of the rent before & after the rent be behynd & he distreyn & rescous to him be mad he shal haue assise or a writ of rescous

¶ And note wel that in euery assise of rent charge and annuall rent or in a writ of annuite it behouyth to hym that bryngyth the wryt to shew forth an especialte / or ellys he shall not maytayne assyse / but in a mordaūcest our or formedoun in the descender or other wryttis in the which tytle is gyffyn or comprisid of rent charge or anuell rent it nedyth not to shew especialte .

¶ And note well that yf a man graunt a rent charge to a nother / and the graunte purchase the halff of the land wherof the rent is goynge owt / all the rent is extynct and yf the graunte relesse to the grauntour parcell of the rent / yet all the rent is not extynct / But in rent seruyce not withstondyng that the lorde hath purchaysyd the halff of the land wherof the rent is goyng owt / yet the rent is not extynct but for the halff / and the cause is of the dyuersite for that that rent seruyce may be seueryd to one parson but not rent charge .

¶ And note well that yf rent charge be grauntyd to two ioyntenauntys and the one relesse / yet the other shall haue the halff of the rent / and also yf one purchase the halff of the land wherof the rent is goyng owt the other shall haue the halff of the rent of his companion / And yf the dissersour charge the land to a straunger and the disseyse bryng assise and recouer the charge is defetyd / But yf he that hath ryght charge the land and a straunger fayne a false accion agayns hym and recouer by defaute / the charge abydyth .

¶ And note well that in case that purparte be betwen two perceners and more land be alottyd to one than to the other and she that hath more of the land chargyth her land to the other and she happyth the rent she shall maynteyn assise without especialte / and yf the graunte haue it in fee symple or in fee tayle and hath issue and dyeth / yf the issue bryng a formedone or assysc of mordauncestour he shall neuer be chargid to shew an especialte .

¶ Rent sek is wher a man holdith of me by homage fealte & other seruyce yeldyng to me a certayne rent by the yere and I graunt this rent to a nother reseruyng to me the seruyce .

¶ And not well that in rent sek if a man be seisid of the rent / and the rent be behynd he may not distreyn but he shal haue assise of nouell disseysyn .

¶ And note wel that yf rent sek be grauntyd to a man and to his heyrys and the rent be behynd & the grauntour dye the heyre may not distrayne nor shall not recouer the areragis of the tyme of his fadyr as it is before sayde of rent seruyce .

¶ And in the same maner it is to sey of rent charg or anuell rent / But in all these rentis before sayd the heyr may haue for the areragis in his own tyme sych aduauntage as his fadyr had in his lyfe .

¶ And note well that in rent sek yf a man be not seisid of the rent and it be behynd he is without recouer for that that it was his own foly at the begynnyng when the rent was grauntyd to hym or reseruyd that he toke not seisin of the rent as a peny or . ii . d.

¶ And note well that a man may not haue a cessa uit per biennum or a nother wryt of entre sur cessauit for no rent sek behynd by . ii . yeris but they may all only for rent seruyce as it apperyth in the statute .

¶ And note well that in rent sek it behouyth for hym that sewith for the rent sek for to shew a dede to the tenaunt or ellis the tenant shall not be chargyd of the rent but wher the rent sek was rent seruyce before / as in this case / lord mesne & tenant & euery of them holdyth of other by homage fealte & . x. s. of rent / the lord ꝑamount purchaysith the landꝭ or tenementis of the tenant / all the signioury of the mesne but the rent is extynet / And for this cause this rent is become rent sek / & the rent seruyce chaungyd / for he may not distreyn for this rent / & i this case he the demaundith the rent shal neuer be chargyd to shew a dede / also in a wryt of mordauncestour ayle nor besayle of rent sek it nedyth not to shew a specyalte for y● that these wryttis of possession do comprehend a tytle within them selff that is to say that the auncestour was seised of the same rent and continuyd his possession by cause of which seysyn the law supposith that it is also auerable by the countrey tamen quere for some suppose that yt behouyth of nessite to shew forth a dede for that that rent sek is a thyng agayns comyn ryght as well as rent charge / But in assise of nouell disseysyn and in a wryt of entre sur disseysyn brought of rent sek it behouyth of necessite to shew forth a dede for vat that rent sek is a thyng agayns comyn ryght except in the case befor seyd where it was rent seruyce before

And assise of nouell dissyesyn a wryt or entre sur cessaunt conteyn with in them no tytle but suppose a disseisyn to be don to the playntyff and of the intendement of the law the disseysyn gyffyth no cause of auerment agayns comyn ryght but of necessite it behouyth to shew forth a dede
